
Dr G Shanmugappa, Chairman-All India Motor Transport Congress, saidWe write to you to expose the vested interests of perpetrators of the Strike call and its mobilization through deliberate dissemination of misinformation and malicious propaganda. These entities are actively involved in spreading unfounded rumours, and inciting drivers to create unrest and instability in the state and the country.
The focal point of their campaign revolves around the Hit & Run Case under section 106 (2) of BhartiyaNyaya Sanhita (Second) 2023, which, it’s crucial to note, has been kept in abeyance by the Government ofIndia. (copies of the same are enclosed)
This orchestrated effort to manipulate drivers sentiment is not only misleading but also has the potentialto disrupt the normal functioning of essential services, create unnecessary chaos and pose a serious threatto internal security.
Considering the gravity of the situation, we earnestly request your kind intervention to counteract theseactions by exposing their nefarious designs and highlight the Government’s decision to keep the provisionunder BNS2 under abeyance, in your esteemed media.
We would also like to bring to your kind notice the turn of events that has led to unrest anddiscontentment among our drivers’ brethren and the Government has given its assurance in writingthat the provision regarding Hit & Run Case under section 106 (2) of Bhartiya Nyaya Sanhita(Second) 2023 is not implemented and any decision on it will be taken after discussions, thusquelling the rumours and misinformation unleashed campaign by the vested interests and antisocial elements.
1.0) The Government published Gazette of Bhartiya Nyaya Sanhita (Second) 2023 on December 25, 2023.
2.0) Team AIMTC immediately took cognizance of the harsh provisions reg. Hit & Run Case under section 106 (2) of BNS2.

am AIMTC anticipated the likely implications and repercussions of the said provision and on December 27, 2023 wrote detailed letter to Shri Narendra Modi Ji, Honourable Prime Minister, Shri.Amit Shah Ji, Hon’ble Home Minister, Shri Nitin Gadkari JI, Shri J P Nadda Ji and all Members of Parliament (Lok Sabha & Rajya Sabha) highlighting our concerns.4.0) In the next few days, the rumours flew thick and fast across the country and the driver brethren started leaving their jobs and the transportation and supply chain specially of essential commodities and export – import got impacted
5.0) We continually engaged the Home Ministry at the highest level and highlighted the alarming situationarising out of it and asked them of the revocation of the provisions for Hit & Run cases under BNS2to quench the discontentment among the drivers.
6.0) It was by and large decided that AIMTC shall stand in support of our drivers’ brethren who are part ofour family and we will ask the government not to implement the harsh provisions in the BNS2.
7.0) During this time, our President (Shri Amritlal Madan) got a call from Ministry of Home Affairs andhe very boldly put the concerns of the drivers’ brethren to him and as such a mecting was scheduled at6.00 pm with Home Secretary and senior officials of MHA.
8.0) The announcement at the Press Meet was postponed for after our mecting with Home Secretary Sir.
1 9.30 pm and apart from all major9.0) The meeting with Home Secretary Sir went on from 6.00 pmaconcerns of our drivers’ brethren were discussed and emphasized. He was positive and understoodathe issues in an empathetic manner. He agreed to our demand to keep the said provision inabeyance and for its amendment later on after due consultations with the Team AIMTC.
10.0) The Home Secretary, Government of India also issued Press Release there and then and conveyed thedecision through media byte that we had widely circulated.
11.0) There are mischief mongers and vested interests, which are trying to circulate unfounded rumours andmislead drivers’ brethren again and take advantage of the situation.
12.0) To dispel the misconceptions and ongoing tirades, we again wrote to the Home Minister, HomeSecretaryothers and late night yesterday we got the letter from MHA, re-confirming thatthe the provision regarding Hit & Run Case under section 106 (2) of Bhartiya NyayaSanhita (Second) 2023 is not implemented and any decision on it will be taken after dueconsultations with AIMTC.
We are constantly appealing our members and drivers brethren not to fall prey to the designs of the anti-social elements and vested interests who want to take their advantage to secure their self interests..
We once again request our sisters and brothers from esteemed media to please clarify and spread the message amongst the fraternity THAT THERE IS NO STRIKE AS SUCH IN THE COUNTRY ASTHE GOVERNMENT HAS ACCEDED TO OUR DEMANDS, At present old law is implemented inthe country in of accident and there is no need to fear or worry about the new provisions that are now in abeyance.
